Terms and Definitions

a. Personal Data (PD) – any information relating directly to the User.

b. User – a person who entered into a contractual relationship with the service provider.

c. Subject – an individual to whom the PD relates.

d. Owner – a website operator collecting PD as part of the services provision process.

1. General Provisions

1.1. This Policy regarding the collection of PD has been developed in accordance with the current laws and determines the procedure for working with the PD of Users and the requirements for ensuring protection.

1.2. Measures to ensure the protection of PD are an integral part of the Owner’s obligations.

1.3. The Owner is not responsible for the information provided in a public form.

1.4. The Owner has the right to record conversations. At the same time, the Owner undertakes to prevent attempts of unauthorized access to the User’s PD.

2. Principles of PD Collection

2.1. The Owner takes all necessary measures to comply with the requirements of the current laws.

2.2. Prevention of a PD collection that is not required for the provision of services, as well as excessive in relation to the stated purposes. The Owner collects PD solely for the purpose of fulfilling obligations.

2.3. The Owner takes all measures possible to maintain the relevance of the collected PD. The User has the right to receive his PD for review and request the deletion of PD if the collected information is inaccurate or obtained illegally.

2.4. Storing PD in a form that allows to identify the User for no longer than is required for the provision of services.

3. Conditions of PD Collection

3.1. The collection of a PD is allowed only upon the User’s consent. The PD is subject to disclosure in accordance with the law.

3.2. The PD can’t be disclosed to third parties without the User’s consent.

3.3. The Owner doesn’t collect PD related to race, nationality, political affiliations, religion and beliefs.

3.4. The PD that has legal consequences is subject to verification by authorized employees.

4. Collection of PD

4.1. The Owner only collects PD necessary for the provision of the services.

4.2. The PD can be used for the purposes of service provision, User identification, interaction and conducting statistical research.

4.3. The Owner undertakes to use the collected PD in compliance with the applicable laws.

4.4. The confidentiality of the PD is maintained in all cases except when the specific information is available publicly.

4.5. The Owner has the right to disclose PD without the User’s consent to the law enforcement agencies at their motivated request, Owner’s partners to fulfil contractual obligations and in other cases provided for by the current laws.

4.6. The Owner has the right to transfer PD to third parties if the user has expressed his consent.

4.7. The Owner carries out an automated collection of PD.

4.8. Access to information databases containing PD is provided by a two-level password system. Passwords are set by authorized employees.

5. Changes to PD

5.1. The User can update PD at any time.

5.2. The User has the right to delete PD.

6. Confidentiality of PD

6.1. The Owner ensures the confidentiality of the collected PD in the manner prescribed by the law.

6.2. Confidentiality is not required after anonymization.

6.3. PD is subject to mandatory disclosure in accordance with the law.

7. Principles of PD Protection

7.1. Taking measures aimed at preventing unauthorized access to PD and transfer to third parties who do not have the legal right to access such information.

7.2. Timely detection of unauthorized access to PD.

7.3. Provision of means for the immediate recovery of PD modified or destroyed due to unauthorized access.

7.4. Immediate elimination of violations of the procedure for providing PD.

7.5. Access to PD of any third parties without the consent of the User is excluded.

7.6. PD can’t be used for purposes that contradict the requirements of the law.

8. User’s Consent to the Collection of PD

8.1. The User decides to provide his PD of his own free will and in his interest. The decision to allow the collection of PD must be informed and conscientious.

8.2. The list of collected PD includes full name, contact number, email address, residence address and IP address.

8.3. The PD contained in the state registers of legal entities is considered to be open and publicly available. The protection of confidentiality is not required.

8.4. In case the PD is requested by organizations that don’t have the appropriate authority, the Owner is obliged to obtain the consent of the User prior to disclosing the information and warn the third parties that the PD can be used only for the specific purposes.

8.5. The User confirms his consent to the transfer of PD in electronic form.

9. Rights of PD Subjects

9.1. The User has the right to request information regarding the PD collection. The User has the right to demand PD clarification, deletion or blockage if the information is incomplete, outdated, inaccurate or obtained illegally.

9.2. If the User believes that the PD is collected in violation of the requirements of the law, he has the right to appeal against the actions of the Owner in court.

9.3. The User has the right to protect his rights and legitimate interests, including compensation for damages.

10. PD of Third Parties

10.1. The User has the right to enter data of third parties.

10.2. The User undertakes to obtain the consent of the PD Subject for collecting information.

10.3. The Owner undertakes to protect the PD of third parties entered by the User.

11. Advertisements and Surveys

11.1. The received email addresses and phone numbers can be used by the Owner to send messages to Users, including mailings with any information of a commercial or informational nature about the provision of services.

11.2. Users can unsubscribe from receiving such mailings at any time.

12. Cookies

12.1. The Owner has the right to use cookies that do not contain confidential information. The User hereby consents to the collection, analysis and use of cookies, including by third parties for the purpose of generating statistics and optimizing this website.

13. Other Provisions

13.1. Any disputes are subject to resolution in accordance with the current laws at the place of registration of the Owner. The User must comply with the pre-trial procedure and send the Owner a claim in writing before going to court.

13.2. If one or more provisions of this Policy are found invalid, it doesn’t affect the validity or applicability of the remaining provisions.

13.3. The Owner has the right to make changes to this Policy at any time without prior agreement with the User.

13.4. The User undertakes to monitor changes to the Policy.
